Forever Fiji – Terms & Conditions

• A $250 non-refundable commitment payment per adult is required and will be applied to the total cost of your booking, subject to your rights under applicable New Zealand consumer law.
• Balance of payment is due 60 days prior to departure, or earlier where a supplier requires it.
• Cancellations within 60 days of departure will incur a 100% cancellation fee, subject to your rights under applicable New Zealand consumer law.
• Prices are subject to fare, supplier and currency changes until final payment.
• After full payment, only a new or increased government tax, levy, fuel surcharge or other mandatory third-party charge applicable to the booking may be passed on, to the extent permitted by law.
• We may charge service fees and earn package margins, commissions and other commercial remuneration in connection with your booking.
• Travel insurance is strongly recommended.

By making a booking with Forever Fiji, you acknowledge that you have read, understood and agreed to these Booking Terms & Conditions. Payment of any deposit or commitment payment, or confirmation of a booking, constitutes acceptance of these Terms by the person making the booking on behalf of all travellers listed on the booking.

Bookings are subject to the availability of air, land and sea services at the time of the booking request. All quotes are subject to change until final confirmation of the booking request is made in writing.

All pricing is subject to fare changes, supplier changes and currency fluctuations, with or without notice, and cannot be guaranteed until payment is made in full, except where a supplier requires earlier ticketing or payment to secure a particular rate.

After full payment has been accepted for confirmed services, we will not increase the agreed package price because of ordinary exchange-rate movements or general supplier price increases. However, a new or increased government tax, levy, fuel surcharge or other mandatory third-party charge that becomes applicable to your booking may be passed on to you, even after full payment, to the extent permitted by law.

A Commitment Payment of $250 per adult is required at the time of confirmation and is contributed toward the final cost of your booking.

The Commitment Payment is non-refundable and non-transferable if you cancel, subject always to any rights or remedies you may have under applicable New Zealand consumer law. It contributes toward the costs of research, planning, booking, administration and service already provided in establishing your booking.

This payment is in addition to any other deposits or payments required by a resort, supplier or airline. These will be advised at the time of booking.

Some resorts and other suppliers require additional deposits and these will be advised at the time of confirmation.

The balance of payment is due 60 days prior to departure, or earlier as advised by your destination specialist where required by a supplier.

If no payment or notification has been received within 7 days after a payment becomes overdue, we may treat the booking as cancelled after making reasonable attempts to contact you. Cancellation charges may then apply.

If the booking is made within 60 days of departure, full payment is required immediately unless otherwise advised.

Payments processed in foreign currency may incur a currency conversion or international transaction fee charged by your financial institution. These fees are not charged by us.

Available payment methods will be advised to you. Forever Fiji does not charge clients a separate fee or surcharge based on the payment method used. Your bank, card issuer or other payment provider may separately charge fees which are outside our control.

Airfares are subject to the respective airlines’ fare rules and conditions and may be non-refundable and non-changeable once paid for or ticketed.

Please check with us for additional details relating to the airfare rules applicable to your booking.

We reserve the right to charge a fee of $250 per transaction for amendments to confirmed itineraries, in addition to any fees, fare differences or other charges imposed by the resort, airline or other supplier.

Should you or any member of your travelling party cancel, you must notify us in writing.

We reserve the right to charge a cancellation fee of $250 per adult to administer your cancellation and to retain commissions, retainers or other remuneration earned in connection with services already provided, to the extent permitted by law.

These cancellation charges are in addition to cancellation fees, non-refundable amounts or other charges imposed by the resort, airline or any other supplier.

Cancellations within 60 days of departure will incur a 100% cancellation fee, subject always to your rights under applicable New Zealand consumer law.

Cancellation fees apply regardless of the reason for cancellation. Travel insurance may provide cover for certain cancellation circumstances, subject to the policy terms and conditions.

When you pay us, funds may be applied to suppliers on your behalf. Many of our suppliers are located overseas.

Where a refund may be applicable, we may need to request funds from the relevant supplier before the supplier-funded portion can be returned to you.

There may be supplier processing times, bank fees and foreign exchange movements which affect the timing or amount received. We will not be responsible for delays caused solely by a supplier or financial institution, but nothing in this clause limits any refund or remedy required by applicable New Zealand consumer law.

Payments received from you in connection with your booking are deposited into a dedicated client account maintained separately from our general trading account. The client account is operated separately from our general business funds for the purpose of managing payments relating to client travel arrangements. It is not represented as a statutory trust account.

Funds in the client account may be applied to payments due to airlines, accommodation providers, transfer operators, tour operators and other travel service providers, together with fees or other amounts properly payable in connection with your booking.

Before full payment, Forever Fiji may adjust the price of a package where factors outside our control alter the cost of the booking, including airfare increases, currency fluctuations, hotel or supplier price increases, government taxes or levies, fuel surcharges or increases in services forming part of the package.

After full payment, any price adjustment will be limited to a new or increased government tax, levy, fuel surcharge or other mandatory third-party charge that becomes applicable to your booking and may lawfully be passed on.

We also reserve the right to amend an itinerary when reasonably necessary because of changes beyond our control. Where a change is material, we will advise you and assist with available alternatives or remedies, subject to supplier terms and applicable New Zealand consumer law.

Due to contractual obligations with our suppliers, we cannot and do not itemise confidential wholesale package costs or our commercial margin.

Your total package price includes the travel components together with research, planning, booking, administration and co-ordination costs.

We pay many overseas suppliers in foreign currencies, including Fiji Dollars.

Until final payment, prices may vary due to fluctuations in the exchange rate applicable to unpaid foreign-currency components of your booking.

Our exchange rate at the date of deposit is only taken into account for the amount actually paid or committed to the overseas supplier at that time.

You can lock in the exchange rate of the foreign-currency components of your confirmed booking by paying the balance of your booking in full, subject to any new or increased mandatory tax, levy, fuel surcharge or other mandatory third-party charge that later becomes applicable.

We are a commercial travel business and may be remunerated in several ways in connection with your booking.

Our remuneration may include service, booking, amendment or cancellation fees paid by you; a margin incorporated into a package or travel-service price; commissions paid by airlines, accommodation providers, tour operators, wholesalers and other travel service providers; and incentives, overrides, rebates, retainers, marketing contributions or other commercial benefits from travel service providers or business partners.

Unless required by law or specifically agreed otherwise, we are not required to separately itemise our commercial margin, commission or other remuneration included within a package or travel-service price. Any fee payable directly by you to us in addition to the quoted price will be disclosed before it is charged.

Travel insurance is strongly recommended for protection against medical costs, cancellation, travel disruption, loss or theft of luggage and other risks.

We strongly recommend that you purchase comprehensive travel insurance at the time of paying your deposit so that cover may be available for events occurring before departure, subject to the policy terms and conditions.

If you choose not to purchase travel insurance, you acknowledge that you have been advised of the importance of obtaining adequate cover. Nothing in this clause removes any responsibility we may have under applicable New Zealand consumer law.

It is your responsibility to ensure that every traveller has a valid passport and meets all passport, visa, transit, health and entry requirements for each destination and transit point.

Passport validity, visa, transit, health and entry requirements vary by destination and can change. You should check current official requirements before travel, including the New Zealand Government SafeTravel website and the relevant immigration authorities.

It is your responsibility to ensure that passport names exactly match airline ticket names and that correct information is provided to us at the time of booking.

We will not be responsible for loss or expense resulting from incorrect information supplied by you or a failure to obtain required travel documents, except to the extent caused by our own error or where liability cannot lawfully be excluded.

Baggage allowances vary from airline to airline and in some instances the airfare you have purchased may not include checked baggage.

Please check with your destination specialist and the relevant airline regarding baggage allowances and restrictions applicable to your travel arrangements.

We act as a booking agent or intermediary for airlines, hotels, transfer operators, cruise companies, tour operators and other travel service providers. Those travel services are provided by independent suppliers over whom we have no direct control.

When we arrange a third-party travel service, the supplier’s own terms and conditions may also apply to that service. Those terms are separate from our Booking Terms & Conditions.

We are not responsible for the independent acts, omissions, errors, delays, cancellations or service failures of suppliers merely because we arranged the booking. This may include airline schedule changes, flight delays or cancellations, resort closures or overbookings, transfer delays, cruise itinerary changes, weather disruptions, mechanical failures or other operational decisions.

We will always assist our clients wherever reasonably possible. Nothing in this clause excludes or limits responsibility that applicable New Zealand consumer law or another applicable law places on us for our own booking and advisory services, representations, negligence or other conduct.

Travel arrangements may be affected by events outside our control, including airline schedule changes, government travel restrictions, border closures, quarantine requirements, health regulations, weather events or operational decisions made by travel suppliers.

We will use reasonable endeavours to assist clients in managing such disruptions. Any changes, refunds, credits or alternative arrangements may also be subject to the terms and conditions of the relevant airline, resort or other travel supplier and to applicable New Zealand consumer law.

Additional costs arising from a disruption are not automatically payable by us. Responsibility will depend on the circumstances, supplier terms, insurance and applicable law.

We will always endeavour to ensure that the booking and advisory services we provide are satisfactory and are supplied with the care and skill required by law.

We do not accept liability for acts, omissions or defaults of independent suppliers over whom we have no direct control, except to the extent liability arises because of our own conduct or cannot lawfully be excluded.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under applicable New Zealand law.

Neither we nor a supplier will be responsible for a failure or delay caused by circumstances beyond reasonable control, except to the extent applicable law provides otherwise.

Such circumstances may include natural disasters, war or civil unrest, terrorism, government action or restrictions, airline operational decisions, border closures, quarantine requirements, epidemics or public health emergencies, strikes or industrial action, fire or explosion, interruption of transport services, or failure of utilities or communications.

Where such an event occurs, supplier terms may determine available refunds, credits, rebooking or alternative arrangements. We will use reasonable endeavours to assist you. Nothing in this clause limits your rights under applicable New Zealand consumer law.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986 where those laws apply.

We collect, use and disclose personal information to respond to enquiries and provide booking and advisory services, including arranging services with airlines, hotels, transfer operators, tour operators and other providers.

Your personal information may be shared with suppliers, contractors, technology and cloud service providers and others where authorised or required by law. Some recipients may be located overseas, including in Fiji, Australia and other countries relevant to your travel arrangements.

For further information about how we handle personal information, please refer to our Privacy Policy. Marketing consent is separate from acceptance of these Booking Terms & Conditions.

When you make a booking with us, legal obligations arise. Your rights and obligations are governed by these Booking Terms & Conditions together with any applicable supplier terms and your rights under New Zealand consumer law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986 where applicable.

You must not make a booking unless you understand and agree to these Terms. Payment of any deposit or commitment payment, or confirmation of a booking, constitutes acceptance of these Terms by the person making the booking on behalf of all travellers listed on the booking.

These Booking Terms & Conditions are governed by the laws of New Zealand, subject to any mandatory law that applies to you or the booking.

You and we submit to the non-exclusive jurisdiction of the courts and tribunals of New Zealand. Nothing in this clause limits any right or remedy available to you under applicable law.
